These terms and conditions apply to all offers, transactions and agreements of Beate Marie Photography ("Beate Marie"). Before placing an order, you will have an opportunity to read and save these terms.
An agreement is formed when I confirm your order by email. I reserve the right to decline an order without giving reasons.
Prices are provided on request, in euros and including VAT unless stated otherwise. A later price change does not affect an order that has already been confirmed.
Payment is made through Stripe's secure payment environment. Available payment methods may include credit card, iDEAL and other methods shown at payment.
Each artwork is produced after an agreement is formed. The standard finish is a fine art print with Diasec® mounting by the printmaker. Framing is available only on request and only where agreed in writing. Production planning is confirmed after the enquiry. Delivery and insurance are arranged individually.
The website does not show a fixed price. Price, finish and delivery are agreed personally. Once agreed, the standard finish includes production and Diasec® mounting. A frame, fitting a frame, wall mounting and delivery beyond the agreed destination are excluded unless expressly agreed in writing beforehand.
Delivery is planned after the agreed production is complete. The carrier, packaging and insurance cover are agreed in writing for each artwork and destination. Wall installation, mounting and fitting a frame are excluded unless expressly agreed in writing beforehand.
Statutory distance-selling rules apply to consumers. Where the right of withdrawal applies, you may withdraw from the agreement without giving a reason within 14 days after the day on which you, or a third party appointed by you, receive the artwork.
The statutory exception for made-to-measure goods may apply only where an artwork is made to your individual specifications or is clearly personalised for you. Producing a standard finish after an order is placed does not by itself remove the right of withdrawal. If the exception applies to a specific order, this will be stated expressly for that finish before payment.
You may withdraw by sending an unambiguous statement to info@beatemariephotography.art. Please include your name, order number, the artwork concerned and the date of receipt. After withdrawal, the artwork must be returned within 14 days. Because of its size, weight and fragility, insured return transport must be arranged in advance.
You bear the direct return costs where you were clearly informed of this before the order. If the artwork cannot normally be returned by post, you will receive an estimate of those costs before payment. If no estimate was provided, those direct return costs will not be charged to you.
Following a valid withdrawal, payments received, including the cost of the standard delivery offered, will be refunded within 14 days. The refund may be withheld until the artwork has been received or you provide proof of return. A deduction may be made only for diminished value caused by handling beyond what is necessary to establish the artwork's nature, characteristics and functioning.

Your statutory rights remain in force if an artwork is defective, damaged in transit or delivered incorrectly. In that event, contact info@beatemariephotography.art promptly so that I can arrange an appropriate solution with you.
Ownership of the supplied artwork passes to you once full payment has been received.
All photographs, text, designs and other material on this website are protected by copyright and are the intellectual property of Beate Marie.
You may not copy, distribute or otherwise make material from this website public without prior written permission.
Acquisition transfers ownership of the physical copy, but not copyright or reproduction rights. Reproduction, commercial use or distribution of images of the artwork requires prior written permission.
A limited-edition print comes with a certificate of authenticity stating the edition number, such as 2/5 or 1/1. This records the artwork's place within the edition.
Each limited-edition artwork is signed and uniquely numbered for authentication.
If an artwork has a production defect, I will repair or replace it without charge, as appropriate.
This does not cover normal wear or damage caused by improper use or handling. Your statutory rights relating to conformity remain unaffected.

Liability is limited only to the extent permitted by law. Nothing in these terms limits mandatory consumer rights or liability that cannot lawfully be excluded.
Dutch law applies to all agreements. This choice of law does not deprive a consumer of the mandatory protection provided by the law of the country in which that consumer habitually resides.
